With effect from 2 July 2023, the new Whistleblower Protection Act (HinSchG) will enter into force (Federal Law Gazette Part I - Act for Better Protection of Whistleblowers and for the Implementation of the Directive on the Protection of Persons Reporting Breaches of Union Law - Federal Law Gazette).

Companies with 50 to 249 employees will only have to comply with the provisions of the HinSchG from 17 December 2023, for all other companies the deadline is 2 July 2023. Violations of the law are punishable by fines of up to €50,000. In addition, there are claims for damages by affected persons.

From the end of the year, so-called whistleblowers will have special protection in medium-sized companies with 50 or more employees. Correspondingly affected companies are now in debt and would do well to inform themselves comprehensively. It is now time to make all the preparations for what exactly needs to be decided, initiated and ultimately implemented.
